provide affirmative marketing guidelines for assistance in setting up such a program if Dove Inc. does not already have a plan in place. Dove, Inc.shall submit a plan for affirmative marketing of its project(s)prior to the award of funds. B. W/MBE Dove Inc. will use its best efforts to afford minority and women-owned business enterprises the maximum practicable opportunity to participate in the perfortnance of this contract. As used in the contract, the term "minority and female business enterprise" means a business at least fifty-one percent (51%) owned and controlled by minority group members or women. For the purpose of this definition, "minority goup members" are Afro-Americans, Spanish-speaking, Spanish surnamed or Spanish-heritage Americans, Asian Americans, and American Indians. Dove Inc. may rely on written representations by the contractors regarding their status as minority and female business enterprises in lieu of an independent investigation. VIII. ENVIRONMENTAL CONDITIONS A. Air and W ater Dove Inc. agrees to comply with the following regulations insofar as they apply to the performance of this contract: Clean Air Act,U.S.C., 1857, et seq. Federal Water Pollution Control Act, as amended, 33 U.S.C. 1251, et seq., as amended 1318 relating to inspection, monitoring, entry,reports, and information, as well as other requirements specified in said Section 114 and Section 308, and all regula- tions and guidelines issued thereunder. Environmental Protection Agency(EPA)regulations pursuant to 40 CFR Part 50, as amended. National Environmental Policy Act of 1969. HUD Environmental Review Procedures (24 CFR, Part 58). B. Flood Disaster Protection Dove Inc. agrees to comply with the requirements of the requirements of the Flood Disaster Protection Act of 1973 (P.L.-2234) in regard to the sale, lease or other transfer of land acquired, cleared or improved under the terms of this contract, as it may apply to the provisions of this contract. 5
