1. R.E.I.D. will prepare complete engineering plans and drawings for said Roads, in <br /> full compliance with all CITY standards and specifications, and including traffic control and <br /> signing, with striping and pavement marking, right-of-way development with landscaping, ', <br /> sidewalks and relocation of any existing utilities, and submit them to the CITY'S ' <br /> Department of Engineering and Infrastructure for approval prior to the start of any <br /> construction. The plans for the Roads shall show water and sanitary sewer mains <br /> e�ended therein, and shall also show a right-of-way of not less than seventy (70) feet, <br /> with a pavement width of forty-seven (47) feet, curb face to curb face, exclusive of the <br /> median, and a center median, suitable for landscaping, having a typical width of <br /> seventeen (17) feet between adjoining curb faces; provided that, the median may be <br /> reduced to accommodate separate left turn areas, at which points the minimum width shall <br /> be five (5) feet between adjoining curb faces. The plans shall also show street lighting of <br /> a kind similar to that located on West Main Street, adjacent to the campus of Millikin <br /> University. <br /> 2. After approval of said plans by the Department of Engineering and <br /> Infrastructure, R.E.I.D. shall submit to the CITY a proposal by a qualified, responsible <br /> contractor for the construction of the Roads. Such proposal shall show that the contractor, <br /> and all subcontractors, shall pay employees wages and benefits in accordance with the <br /> Illinois Prevailing Wage Act (820 ILCS 130/0.01 et seq., the "Act"), and comply with all <br /> other requirements of the Act. The Director of the Department of Engineering and <br /> Infrastructure is hereby authorized to approve such proposal, based upon normal and <br /> customary engineering and construction costs and in order to construct the infrastructure <br /> for this quality upscale planned unit development, but not to exceed One Million Seven <br /> Hundred Fifty Thousand Dollars ($1,750,000.00); provided that, in the alternative, said <br /> Director may approve reimbursement not to exceed that amount if the proposed cost is <br /> greater than same, with R.E.I.D. responsible for the remainder of said proposed cost, <br /> based upon the same criteria. Said Director is also authorized to disapprove any proposal <br /> which, in said officer's discretion, does not meet the criteria stated herein. Upon approval <br /> by the Director of said proposal, R.E.I.D. shall execute a contract with said contractor for <br /> the approved proposal price, and said contractor shall then construct said Roads <br /> according to the approved plans and specifications, but only after a pre-construction <br /> conference with the CITY and subject to regular inspection, testing and sampling during <br /> such construction by representatives of the CITY, access for which is hereby granted by <br /> R.E.I.D. R.E.I.D. further agrees that such construction will cease upon orders from the <br /> Director of Engineering and Infrastructure specifying areas of non-compliance with the <br /> CITY'S standards and specifications or the terms of this agreement, until such <br /> non-compliance is remedied. R.E.I.D. shall not agree to any increase in the contract cost <br /> for the construction of the Roads without the written consent of the Director of the <br /> Department of Engineering and Infrastructure, which officer is hereby authorized to <br /> approve such increases but not in excess, cumulatively, of Ten Per Cent (10%) of the <br /> original proposed cost. <br /> 3. Approval by the Department of Engineering and Infrastructure of the plans and <br /> drawings for the construction of the Roads, and approval by said Department of the <br /> proposal price of the contractor, as provided in sections 1 and 2 hereof, are conditions <br /> 2 <br />
