\ <br /> � � <br /> r k � � <br /> . t <br /> to the execution of this contract, if any, in such form and together with such <br /> documentation as shall be required for recording said deed. Seller shall also furnish <br /> Buyer, at settlement, all documentation necessary to protect Buyer from mechanic's <br /> liens. Seller shall further deliver to Buyer a fully executed agreement between Seller <br /> and Tenant under which Tenant agrees, for consideration, to relinquish and waive its <br /> rights to the premises on and after March 31, 2001, and further agrees to vacate the <br /> premises on or before said date; the title insurance policy furnished pursuant to <br /> paragraph 3 hereof shall show that title to the premises is not subject to said lease with <br /> the Tenant after said date. Seller agrees to prepare the real estate transfer declaration <br /> form. Buyer agrees to pay for the cost of recording with the Recorder of Deeds any of <br /> the documents necessary to complete the transfer of ownership. <br /> 6. At or before settlement Seller shall pay for or give Buyer credit for general <br /> real estate taxes for all prior years and for Seller's pro rata share of such taxes for the <br /> year of settlement. Seller shall further pay or give Buyer credit for all special <br /> assessments now a lien against the premises, rents, if any, and all water and sewer <br /> bills or watermain or sewer connection charges incurred and unpaid as of settlement. <br /> Credit to Buyer for general real estate taxes not yet payable shall be computed on the <br /> basis of the most current tax information available at the time of settlement. <br /> 7. Buyer shall be entitled to possession of the premises at settlement. Tenant <br /> may, however, continue occupancy of the premises through March 31, 2001. <br /> 8. No notices of suits or judgments relating to the premises have been received <br /> by the Seller. I <br /> 9. Notice given or required in this contract or any addendum must be given in ' <br /> writing in one of the following forms: <br /> (i) Personally; <br /> (ii) By certified mail, return receipt requested, properly addressed and all <br /> charges prepaid; and, <br /> (iii) By express delivery with charges prepaid and addressed to the appropriate <br /> party at the address set forth below. <br /> All notices shall be deemed to have been received on the date of personal service or on <br /> the 3rd day following date postmarked. Notice must be served upon or addressed to <br /> Seller or Buyer personally unless otherwise specified.
