, �� ,. � � <br /> ♦' h� <br /> • . � • <br /> ' AMENDMENT TO EMPLOYMENT AGREEMENT <br /> This AMENDMENT TO EMPLOYMENT AGREEMENT is entered into this Sth day of <br /> February, 2001, by and between the City of Decatur, Illinois ("City"), a municipal corporation, <br /> and Steve Garman("Employee"). <br /> WHEREAS, the parties hereto previously entered into and executed as EMPLOYMENT <br /> AGREEMENT, dated September 24, 1999, and subsequently amended November 15, 1999, <br /> which AGREEMENT the parties now wish to amend as set forth herein; and, <br /> WHEREAS, said EMPLOYMENT AGREEMENT shall remain fully enforceable and <br /> effective, as written and previously amended, except as to matters expressly amended or <br /> modified as set forth herein. <br /> NOW, THEREFORE, for and in consideration of the mutual covenants, warranties and <br /> agreements contained herein,the parties hereto do hereby covenant and agree as follows: <br /> 1. The EMPLOYMENT AGREEMENT previously executed and amended as aforesaid <br /> ("AGREEMENT") shall remain in full force and effect, as written and amended, except as may <br /> be modified or amended as expressly set forth herein. <br /> 2. Section 6 of the AGREEMENT shall be amended and modified such that said section, <br /> as so amended and modified, shall provide as follows: <br /> Emplovee's Salarv and Retirement. Employee shall receive a salary at an <br /> annual rate of One Hundred Fifteen Thousand Five Hundred Dollars <br /> ($115,500.00) from the period commencing as of the effective date hereof, and <br /> such salary shall be payable in bi-monthly installments as equalized as <br /> reasonably possible in accordance with the pay plan generally applicable to all <br /> employees of the City. Employee agrees that his salary shall be subject to <br /> normal and customary withholdings which Employee hereby irrevocably <br /> appoints the City as his agent to report such compensation to federal and state <br /> taxing authorities as may be required by law. The City also agrees to review <br /> periodically said salary, and the City may increase said salary if deemed <br /> desirable to the City. <br /> The City also shall execute all necessary documents provided by ICMA <br /> Retirement Corporation for the City's continued participation in the retirement <br /> plan thereof, and shall contribute an amount equal to ten percent (10%) of <br /> Employee's annual salary as deferred compensation to the ICMA Retirement <br /> Corporation Deferred Compensation Plan on behalf of Employee, which <br /> contributions shall be paid at least on a monthly basis. Moreover, the City <br /> shall transfer ownership thereof to succeeding employers upon the termination <br /> of this Agreement. Employee agrees to execute such documents and further <br />
