{ � � <br /> LEGAL DEPARTMENT MEMORANDUM <br /> #2004-OS <br /> May 13, 2004 <br /> TO: The Honorable Mayor and City Council Members <br /> FROM: John Couter, Corporation Counsel���'� <br /> Steve Garman, City Manager Yv�.�,nn <br /> RE: Illinois Ethics Act <br /> The Illinois State Legislature has required all cities to pass ethics ordinances to be <br /> effective not later than May 19, 2004. In response, the Illinois Municipal League has drafted and <br /> distributed a proposed ordinance to comply with the State mandate. That IML suggested <br /> ordinance is presented herewith to the Council, and staff recommends its adoption. <br /> Essentially, the ordinance prohibits the offering or giving of gifts by persons seeking or <br /> doing business with the City, or in a business regulated by the City, to persons employed by the <br /> City, or the soliciting or acceptance of those gifts by City employees. There are several <br /> common-sense exceptions to these prohibitions, such as gifts from friends or family members or <br /> meals not exceeding $75.00 in a single day. The ordinance also prolubits political activities by <br /> City employees during working hours - such activities would include organizing or attending <br /> political meetings, soliciting contributions or distn`buting campaign literature. Violations of the <br /> ordinance could result in fines up to $5,000, and the City could also discipline employees involved <br /> in such violations (including termination). <br /> If any Council member seeks further information, please call Corporation Counsel John <br /> Couter at 424-2807. <br /> Attachment <br />
