Excerpts from Plan Commission Minutes May 6, 2004 <br /> Cal. No. 04-25 Petition of DANE C. BRAGG, Director Economic <br /> and Urban Development Department to rezone the <br /> premises in the 2400 Block of North Twenty-seventh <br /> Street from R-1 Single Family Residence District <br /> to M-1 Heavy Commercial/Light Industrial District. <br /> Ms. Kathy Miller was sworn in by Ms. Jesse <br /> Ms. Miller gave the following recommendation of staff. <br /> I <br /> In 1973, approximately 76 acres were annexed to the City of Decatur. The tract was i <br /> planned for an industrial park and a residential subdivision; the industrial park was <br /> developed but the residential area did not. Currently, the subject tract is being used for a <br /> contractor's yard and for agricultural use. I <br /> The request is to rezone the property from R-1 Single Family Residential District to M-1 '�I <br /> Light Industrial District to reflect the current and future use of the site. The Decatur Area <br /> Urban Land Use Plan shows all of the area as M-1 Light Industrial. ' <br /> The subject property is surrounded by M-1 Light Industrial Zoning; the area is developed ' <br /> as an Industrial Park and a portion is used for agricultural purposes. Rezoning the <br /> property to Light Industrial will not injure the public health, safety or welfare, nor will it <br /> cause substantial injury to the value of other property in the neighborhood. The request is <br /> in harmony with the intent of the Comprehensive Plan. <br /> Staff recommends approval of the rezoning. <br /> The Zoning Ordinance of the City of Decatur (Section XXII A. 2.) requires the Plan <br /> Commission to hold a public hearing on the rezoning request for study and a report on the <br /> effect of the proposed use on the comprehensive plan and compliance with the standards <br /> for review. A recommendation of approval is suggested. <br /> Mr. Jay Dunn asked whether this land was owned by the City. Ms. Miller stated it was <br /> not, it was owned by ADM and the Rathje family. <br /> Mr. John questioned the rules of the Zoning Ordinance; is a contractor yard and <br /> agricultural use is allowed in the R-1 Residence District. Ms. Miller stated that a <br /> contractor yard is not allowed; agricultural use is allowed in a residential district. <br /> Mr. Dunn asked if the owners were requesting this ordinance. Ms. Miller stated they <br /> were not; it is a residential area in the middle of the industrial area and the Department <br /> wanted to clean up the zoning map. The owners are aware of the proposed zoning <br /> change. <br />
