Miller, AICP, Senior Planner �G�'w., l <br /> Suzan Stickle, Planner .S�+f <br /> SUBJECT: Request to vacate the alleyway between the 1200 Block of East Eldorado Street and <br /> East North Street <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the alleyway vacation petition <br /> with the condition that an easement for utility purposes and emergency vehicles will be maintained. <br /> The closing of the alleyway does not appear that it will have an adverse affect on the general public. <br /> Staff is of the opinion that the best interests of the City of Decatur would be served by approving the <br /> alleyway vacation request. The City Plan Commission voted 8-0 to recommend approval of this <br /> petition at the April 1, 2004 hearing; the minutes of the meeting are attached. <br /> BACKGROUND: The petitioner is requesting the vacation of the approximately 16 foot by 310 foot <br /> alleyway located between the 1200 Block of East Eldarado Street and East North Street. The <br /> petitioner would like to have control of the area to be vacated in order to repave the surface � <br /> subsequently allowing him to operate his equipment more efficiently. The petitioner owns the <br /> property abutting the alleyway to the north and south with the exception of the Northwest corner of the <br /> alleyway located at East Eldorado Street and North Jasper Street where the China House currently ' <br /> operates. A 12 inch sewer line is located in the area to be vacated. An appraisal for the alleyway ', <br /> vacation was submitted by the petitioner with an estimated market value of $1,500.00. A second ' <br /> appraisal was not required. ' <br /> INPUT FROM OTI�ER SOURCES: The China House was contacted and has no objections to the ' <br /> vacation. Utility providers have indicated that utilities are located in the alleyway. Fire has requested ''� <br /> emergency access. An easement for emergency vehicles and utilities is required. , <br /> POTENTIAL OBJECTION: There were no objectors to the alleyway vacation at the Plan I'� <br /> Commission meeting. <br /> STAFF REFERENCE: Any additional questions may be forwarded to Suzan Stickle at 424-2781 or <br /> at smstickle(c�decaturnet.org. <br /> BUDGET/TIME IMPLICATIONS: The petitioner will pay the City$1,500.00 for the vacation. <br />
