 , ,
Excerpts from Plan Commission Minutes of March 4, 2004
Cal. No. 04-10 Petition of DANE C. BRAGG, Director of Economic
and Urban Development Department for an amendment
to the City of Decatur Zoning Ordinance (Ordinance
#3512, as amended, Section II).
Mr. Dane Bragg was sworn in by Ms. Jesse.
Mr. Bragg presented the following recommendation of staff.
Per the City Council's direction, staff has initiated an amendment to Section II of the
Zoning Ordinance regarding the definition of restaurant, temporary facilities. As
proposed, the amendment will extend the period of operation for temporary facilities,
commonly referred to as food carts. The Zoning Ordinance currently permits the
operation of temporary facilities from April 1 through November 15 of each year. If
approved, the ordinance would allow the operation for an additional four weeks per year,
from March 15 through November 30. No other changes to the ordinance are proposed at
this time.
Section XXIX of the Zoning Ordinance states that the City Council may, on its own
motion or petition, amend the regulations, but no such amendment shall be made without
a public hearing before the City Plan Commission and its report to the Council. A
motion to forward this item to Council with recommendation for approval or denial is
advised.
Mr. Anderson asked Mr. Bragg if the commission would be receiving copies of the
amended ordinances. Mr. John questioned how often the Zoning Map is updated and
when the Commission will receive the update. Mr. Bragg stated that the Zoning Map is
updated annually and will be reviewed by the City Council on March 15, 2004. The Plan
Commission will be receiving copies of the Zoning Map as well as the amended Zoning
Ordinance in their Apri12004 packet.
It was moved and seconded (Clevenger/John)to forward Cal. No. 04-10 to the City I
Council with recommendation for approval. Motion carried unanimously. li
