Ms. Miller responded , that the line would be down the middle. ' Mr. Nordholm asked how far north it would go. Ms. Miller said the pathway extends all the way from Corman Street to Green Hill Drive all the way through. Mr. John asked when the parking lot and shed were built across the pathway. Ms. Miller stated the path was called an easement at the time of the variance request and site plan review and was within the last five (5)years. Mr. John asked whether it was used by the neighborhood prior to the parking lot as a place to walk. Mr. John believes the City should be keeping pathways friendly to pedestrians and bicycles. Mr. John questioned if the petition was not approved and was not vacated,what would happen to the parking lot. Ms. Miller stated that the shed and fence would have to be removed; the parking lot could remain; the driveway on the south portion would have to be removed. Representing the petitioner, Evan Horath,was sworn in by Ms. Jesse. Mr. Horath stated that when the building was built in 1999, they did have permission from the City to pave over the pathway for their parking lot. Mr. John asked if the shed would be removed if it were not vacated. Mr. Horath stated this is the main entrance and they would do what had to be done. Mr. John asked if it was possible to continue to allow pedestrian's access to the pathway between Corman Street and Green Hill Drive but still allow parking lot to remain. Ms. Miller stated that could be an option. Mr. John asked at what point the no motorized vehicle sign was posted. Ms. Miller stated that it did come along later when the subdivision was developed only because mini bikes and other ATV's were being used on the pathway. Mr. John asked whether it was used by neighbors. Ms. Miller stated that it was used numerous years ago as a walk through to the school bus. There were no objectors present. It was moved and seconded (Nordholm/Dunn) to forward Cal. No. 03-55 to the City Council with recommendation for approval as submitted by petitioner. Motion carried with Commissioners Anderson, Peck, Wakeland, Dunn, Nordholm, and Sadorus all voting to forward to City Council for approval, and Commissioners John and Smith voting for denial.
