GILMAN for a Conditional Use Permit for <br /> the premises at 273 West Prairie Avenue for a residence in an <br /> Office District. <br /> Ms. Kathy Miller, Senior Planner, was sworn in by Mrs. Althoff. <br /> Ms. Miller presented the following recommendation of staff: <br /> The petitioner is requesting a Conditional Use Permit to return the structure, located in an <br /> O-1 Office District,to a single family dwelling unit. The building is currently owned by <br /> Catholic Charities and was previously used as office space. The petitioner plans to return <br /> the structure back to residential use. The petitioner plans to install a new furnace, replace <br /> the roof,paint the home and eventually construct a new garage. The exterior of the <br /> existing building (after improvements) will remain unchanged. A site plan is not required <br /> with the petition as the use will be located in an existing building where adequate utilities <br /> are already provided. <br /> The subject property is located within the boundaries of the Decatur National Register <br /> Historic District. Properties surrounding the building are zoned O-1 Office District; <br /> multifamily residences are located to the west and office uses are located to the east, <br /> north and south. Residential properties are located on the north side of the street as well. I <br /> Returning the property to single family residential use will not injure the public health, <br /> safety ar welfare, nor will it cause substantial injury to the value of other property in the � <br /> neighborhood. The request is in harmony with the intent of the Comprehensive Plan. I <br /> Staff recommends approval of the Conditional Use Permit. I, <br /> The Zoning Ordinance of the City of Decatur(Section XXII A. 2.)requires the Plan � <br /> Commission to hold a public hearing on the rezoning request for study and a report on the <br /> effect of the proposed use on the comprehensive plan and compliance with the standards for <br /> review. A recommendation of approval is suggested. <br /> Mr. John stated he was fine with the action and questioned the revisions to the zoning <br /> ordinance. <br /> Mr. Bragg stated that non-conforming does not prohibit the use and there is no effect on <br /> the density. <br /> Mr. Anderson wants to take a look at the non-conforming issues and wants a better <br /> understanding of how the surrounding areas will be affected. <br />
