Miller, AICP, Senior Planner�v�� � <br /> / <br /> SUBJECT: Conditional Use Permit, 273 West Prairie Avenue <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the Conditional Use <br /> Permit for Residential Use in an O-1 Office District. The Plan Commission reviewed the request <br /> at the July 3, 2003 meeting and recommended approval with a vote of 8 to 0. Plan Commission <br /> minutes are attached. <br /> BACKGROUND: The petitioner is requesting a Conditional Use Permit, as required by the <br /> Zoning Ordinance, to return the structure located in an O-1 Office District to a single family <br /> dwelling unit. The building is currently owned by Catholic Charities and was previously used as <br /> office space before the building at 247 West Prairie was acquired. The petitioner plans to return <br /> the structure back to residential use and live in the home. The owner plans to install a new <br /> furnace, replace the roof, paint the home and eventually construct a new garage. The exterior of <br /> the existing building will remain unchanged. A site plan is not required with the petition as the <br /> use will be located in an existing building where adequate utilities are already provided. <br /> The subject property is located between the Downtown Business District and the locally <br /> designated West End Historic District, within the boundaries of the Decatur National Register <br /> Historic District. Properties surrounding the building are zoned O-1 Office District; multifamily <br /> residences are located to the west and office uses are located to the east, north and south. <br /> Residential properties are located on the north side of the street as well. <br /> Returning the property to single family residential use will not injure the public health, safety or <br /> welfare, nor will it cause substantial injury to the value of other property in the neighborhood. <br /> The request is in harmony with the intent of the Comprehensive Plan. <br /> POTENTIAL OBJECTIONS: There were no objectors to the petition at the Plan Commission <br /> meeting. <br /> INPUT FROM OTHER SOURCES: None <br /> STAFF REFERENCES: If Council members have questions they may contact Kathy Miller at <br /> 424-2786 or at kjmiller@decaturnet.org. <br /> BUDGET/TIME IMPLICATIONS: None <br />
