Upon the acquisition by the City of an easement for the sanitary <br /> sewer, JDN and the City shall execute such documents as may be reasonably requested by either <br /> party to confirm and evidence the dedication of the Dedicated Sewer to the public. <br /> 3. Notices. Any notice required or permitted under this Agreement shall be given in <br /> writing either personally delivered, sent by regular mail with postage prepaid and addressed to <br /> the recipient party at the party's address shown above. All such notices shall be deemed to have <br /> been given on the date personally delivered or mailed. <br /> 4. Choice of Law. This Agreement shall be construed and enforced according to the <br /> laws of the State of Illinois. <br /> 5. Binding Effect. This Agreement shall be binding upon the successors and assigns <br /> of JDN and the City. This Agreement is not intended to benefit any third party and shall not be <br /> enforceable by any third party. <br /> 6. Amendments. This Agreement may only be amended by written agreement duly <br /> executed by the party against whom enforcement of any waiver, change or consent is sought. <br /> 7. Recitals and HeadinQs.
