Miller, AICP, Senior Planner� SUBJECT: Street Right-of-ways and Alley Vacations -- Wabash Crossing (Near North) SUMMARY RECOMMENDATION: Staff recommends approval of the vacation request. Since the existing public right of ways, alleys and easements will be replaced with like services, staff is of the opinion that the best interests of the City of Decatur would be served by approving the request to vacate all right of ways, alleys and easements as indicated on the plat. The Plan Commission reviewed the request at the January 2, 2003 meeting and recommended approval with a vote of 7 to 0 to 2. Plan Commission minutes are attached. BACKGROIIND: As part of the Phase One development, new utility services will be provided including the demolition or abandonment of all existing utility services and the replacement of all water mains, sanitary and storm sewer lines, electric service, phone service and cable lines. Electric service will be predominantly underground with overhead services located in alley areas. � The existing high voltage power lines along Martin Luther King Jr. Drive will be relocated to East Grand Avenue. All existing right of ways, alleys and easements will be vacated and then rededicated according the Final Plat for Wabash Crossing. The Developer, the Decatur Housing Authority and the City have worked closely with the utility companies to ensure adequate placement for all utilities. POTENTIAL OBJECTIONS: There were no objectors to the request for the right-of-ways and alley vacations at the Plan Commission meeting. INPUT FROM OTHER SOURCES: The Decatur Housing Authority, as an adjacent owner is supportive of the vacation. Utility letters have been received from Illinois Power, Insight Communications and SBC stating that they have reviewed the plat and are in agreement with the proposed vacation and the one-year temporary easements for the removal of any existing utility service.
