STAFF REPORT
Decatur City Plan Commission
COMMON NAME: TMS Development: 240 North Church Street
GENERAL INFORMATION
Hearing Date January 3, 2003
Calendar No. 03-02
Property Location Southeast corner of North Church Street and West William Street
Requested Action Conditional Use Permit to allow multiple dwelling units on the
ground floor in the B-4, Central Business District
Petitioner TMS Development L. L. C.
Representative Phillip W. Cochran, PWC.
LAND USE AND ZONING
Direction Existing Land Use Zoning Comprehensive Plan
Subject Property Vacant office building; vacant B-4 Mixed Use
apartment building
North Huston-Patterson building B-4 Mixed Use
South Decatur Club B-4 Mixed Use
East City parking lot B-4 Mixed Use
West Commodore Condominiums B-2 Mixed Use
BACKGROUND
1. The subject property currently consists of two vacant buildings. The building on the corner
was formerly an apartment building with dwelling units on the first floor. The building to the
south was an office building. There is a private alley between the south building and the
Decatur Club. The subject property is located within the B-4 Central Business District.
However, Church Street forms the western boundary of the B-4 District and there is currently
no retail activity in this area. There are no off-street parking requirements in the B-4 District.
2. In the middle of the block along Church there is a curb cut and driveway approach leading to
the sidewalk near the south building. This approach does not lead to a driveway or building
door and therefore serves no purpose. There are also three parking spaces on Church Street
adjacent to the subject properly.
