LEGAL DEPARTMENT MEMORANDUM
NO. 2016-01
February 16,2016
TO: Honorable Mayor Moore Wolfe and City Council
FROM: Tim Gleason, City Manager
Wendy Morthland, Corporation Counsel
Amy Waks, Assistant Corporation Counsel
SUBJECT: Amendments to Chapter 52—Alcoholic Liquor
SUMMARY RECOMMENDATION: Staff requests that Council pass the proposed ordinance
amendment regarding Chapter 52, Sections 7 and 8 allowing for an additional liquor license
classification for wineries. The Winery Special Use permit would allow for a State-licensed
winery to sell wine by the bottle for consumption only off premises during a market-type, special
or festival event for a period of no longer than three (3) consecutive days. The maximum
number of Winery Special Use permits issued to the same winery in one calendar year shall not
exceed six (6) and not more than one Winery Special Use permit shall be granted to any one
winery in any one period of thirty (30) days.
BACKGROUND: Staff received requests for allowance of a license for wineries to sell their
products by the bottle or case at special events. Currently, a temporary license requires that the
organization is only a club, society, fraternity, benevolent or civic organization not for pecuniary
profit and only allows for on-premise consumption.
RECOMMENDATION: Staff recommends the suggested amendments to Chapter 52, Sections 7
and 8.
POTENTIAL OBJECTIONS: There are no known or expected objections.
INPUT FROM OTHER SOURCES:
STAFF REFERENCE:
Amy Waks, Assistant Corporation Counsel, at 424-2807.
BUDGET/TIME IMPLICATIONS: None
