� , <br /> ORDINANCE NO. 2002-105 <br /> ORDINANCE CREATING SILT RETENTION BASIN <br /> SITE MAINTENANCE ADVISORY COMMITTEE <br /> WHEREAS, the Macon County Board, by Resolution No. Z-980-4-02, has granted the <br /> City of Decatur a Special Use Permit for the operation of a silt retention basin in Oakley <br /> Township (the "Basin"), located on a 529 acre site bounded by Angle Crossing Road, Prairie <br /> View Road and Kitchen Road and to be used in conjunction with the dredging of Lake Decatur; <br /> and, <br /> WHEREAS, one of the conditions of said permit requires the establishment of a site <br /> maintenance committee with duties and responsibilities as outlined in said Resolution. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That there is hereby established the Oakley Township Silt Retention Basin <br /> Site Maintenance Advisory Committee("Committee"), which Committee sha11 consist of five(5) <br /> members. One member shall be appointed by the Macon County Board, one member shall be <br /> appointed by the Oakley Township Board of Trustees, one member shall be appointed by the <br /> Macon County Soil and Water Conservation District Board, and two members shall be appointed <br /> by the Mayor of the City of Decatur with the consent of the City Council. <br /> Section 2. That the Committee shall adopt its by-laws and provide for the election of its <br /> officers. The Committee shall meet as provided in said by-laws, but not less frequently than <br /> bi-monthly and pursuant to the requirements of the Illinois Open Meetings Act. All meetings of <br /> the Committee shall reserve time for the public to present verbal or written comments regarding <br /> the maintenance or reclamation issues concerning the basin. <br /> Section 3. That the Committee shall monitor the maintenance operations at the basin and <br /> provide advice to the City of Decatur regarding the implementation of said Special Use Permit <br /> and the site reclamation plan. The Committee shall also serve as a clearinghouse for citizen <br /> complaints, concerns and suggestions regarding the operation and maintenance of the basin. <br />
