� ; ' , � BP Service Station No. 08582 <br /> Groundwater Ordinance <br /> Page 2 <br /> We are working with municipal organizations like yours to have them introduce and pass an <br /> ordinance that provides protection for residents and assists environmental closure and reuse of <br /> sites, while still ensuring BP's responsibility and assistance in the incident. <br /> A ground water ordinance simply prohibits the use of groundwater as a potable source and the <br /> installation of new wells in your community or an appropriate area near an incident. This <br /> ordinance would have to be passed by the City and be approved by the IEPA, which has done so <br /> for 50 communities throughout Illinois in the last several years. <br /> As you know, groundwater is not your municipality's source of drinking water. The City of <br /> Decatur supplies its residences with a municipal drinking water supply through a pipeline <br /> system. Therefore, only the drilling of drinking wells in the area around the station could pose a <br /> health issue. <br /> Though municipalities have varying reasons for introducing and enacting a ground water � <br /> ordinance, the ordinance benefits them all by protecting public health, promoting development <br /> and maintaining the responsibility of the incident on the owner of the site—in this case BP. i <br /> We realize this is a lot of information, but we have found that the more people find out about this <br /> program, the more comfortable they are with it. In that light, we have attached the following: <br /> • a background sheet containing the benefits of enacting a ground water ordinance <br /> • copies of two Groundwater ordinances that are typical of those approved by the IEPA; <br /> one (Springfield) is site specific and the other(Elmwood Park) is for the entire corporate <br /> limits <br /> • draft groundwater ordinance for the City of Decatur <br /> If this approach is acceptable to the leadership of your community we would be available to <br /> assist in preparing language for an ordinance and/or participate in meetings to answer questions <br /> on the use and benefits of the ground water ordinance. <br /> We will follow up with you in several days to discuss this further.
