' Excerpts from Minutes of October 3, 2002 City Plan Commission Meeting <br /> Cal. No. 02-50 Petition of HECKMAN HEALTH CARE to rezone the premises at <br /> 1949, 1959, 1969, and 1995 NORTH MAIN STREET from R-3 Single <br /> Family Residence District to B-1 Neighborhood Shopping District and <br /> on same petition, for subsequent approval of a B-1 Conditional Use Permit <br /> at 1949, 1959, 1969, 1975, and 1995 NORTH MAIN STREET to permit a <br /> structure larger than 6,000 square feet in gross floor area. <br /> Mr. Bragg presented the recommendation of staff: <br /> The subject property contains 34,000 square feet and is cunently improved with three <br /> single-family residences. <br /> The petitioner is requesting the rezoning of the property from B-1, Neighborhood Shopping <br /> District, and R-3, Single-Family Residence District, to B-1 and for subsequent approval of a <br /> conditional use permit to allow a structure larger than 6,000 square feet. <br /> If approved, the petitioner would construct a 9,720 square foot commercial building and a , <br /> 26-stall parking lot. Two new commercial curb cuts would be installed with one providing <br /> ingress/egress from North Main Street and one at West Garfield Avenue. Sanitary sewer and I <br /> water connections would be provided through current facilities that are adequate. Storm <br /> detention would be accomplished via an on-site detention area located alongGarfield Avenue. <br /> The petitioner is also requesting to vary the required rear yard setback between the B-1 district <br /> and an"R" district from 25 feet to 16 feet in order to accommodate the proposed building. The <br /> required buffer yard area and landscaping will be accommodated as per the requirements of the <br /> Zoning Ordinance. <br /> Consideration must be made of the proposed use with respect to area land use and the Main <br /> Street corridor. The proposed use will not threaten the nearby residential properties and will <br /> provide a buffer from the Business 51 corridor. In addition, the provision of landscaping in the <br /> buffer yard area will seek to further protect the residential neighborhood to the west. <br /> With respect to the Main Street corridor, the proposed development will accomplish the goal of <br /> redeveloping underutilized property at the busy Garf'ield and North Main intersection. The <br /> development will be of an appropriate scale for the neighborhood. <br /> Based on these factors, staff is of the opinion that the proposed rezoning and conditional use <br /> permit are consistent with the goals of the Decatur Urban Area Land Use Plan and the Urban <br /> Conidors Plan. Accordingly, staff recommends approval of the petition as proposed. <br /> Mr. Sharpe asked if the properties with the three houses were included in this petition. Mr. <br /> Bragg answered yes, everything was included from the railroad property and everything north to <br /> Garfield. <br />
