Brag ,Economic Developm t ordinator� <br /> SUBJECT: Rezoning 1949 - 1995 North Main Street to B-1,Neighborhood Shopping <br /> District; Conditional Use Permit <br /> SUMMARY RECOMMENDATION: Staff is of the opinion that the proposed rezoning and <br /> conditional use permit are consistent with the goals of the Decatur Urban Area Land Use Plan <br /> and the Urban Corridors Plan. Accordingly, staff recommends approval of the petition as <br /> proposed. <br /> BACKGROUND: The subject property contains 34,000 square feet and is currently improved <br /> with three single-family residences. The petitioner is requesting the rezoning of the property <br /> from B-1, Neighborhood Shopping District, and R-3, Single-Family Residence District, to B-1 <br /> and for subsequent approval of a conditional use permit to allow a structure larger than 6,000 <br /> square feet. <br />' If approved, the petitioner would construct a 9,720 square foot commercial building and a <br /> 26-stall parking lot. Two new commercial curb cuts would be installed with one providing <br /> ingress/egress from North Main Street and one at West Garfield Avenue. Sanitary sewer and <br /> water connections would be provided through current facilities that are adequate. Storm <br /> detention would be accomplished via an on-site detention area located along Garfield Avenue. A <br /> copy of the proposed site plan is attached. <br /> The petitioner is also requesting to vary the required rear yard setback between the B-1 district <br /> and an "R" district from 25 feet to 16 feet in order to accommodate the proposed building. The <br /> required buffer yard area and landscaping will be accommodated as per the requirements of the <br /> Zoning Ordinance. <br /> Consideration must be made of the proposed use with respect to area land use and the Main <br /> Street corridor. The proposed use will not threaten the nearby residential properties and will <br /> provide a buffer from the Business 51 corridor. In addition, the provision of landscaping in the <br /> buffer yard area will seek to further protect the residential neighborhood to the west. <br />
