I
ECONOMIC AND URBAN DEVELOPMENT MEMORANDUM
Memo No. 02-91
September 11,2002
TO: Honorable Mayor Terry M. Howley and City Council Members
FROM: Steve Garm n ity Manager
A. J. Krieg , sistant City Manager
Steve Van Ste uyse,AICP,Planni anager
Kathy J. Mill , AICP,Plannerrn i
SUBJECT: Robertson Charter School,Rezoning to PD,Planned Development District I
1424-1454 East North Street ,
SiJMMARY RECOMMENDATION: Staff feels the petition meets the requirements of the ordinance I
and recommends approval of the petition to rezone the property to PD, Planned Development District. '
The Plan Commission reviewed the request at the September 5, 2002 meeting and recommended
approval with a vote of 8 to 0. Plan Commission minutes are attached. ',
BACKGROiJND: The petitioner is requesting the rezoning of the East North Street site to PD in order I'
to expand the Charter School and maintain a mixed use development. Last year, the Charter School
operated from the building on the west portion of the site (zoned O-1, Office District). The school is
adding another grade and has constructed classrooms in the building across the parking lot (zoned M-3 '
Limited Industrial District). The Zoning Ordinance does not allow Public School uses in Industrial ,
Zoning, therefore it is necessary to rezone the property. It is planned that the existing automobile paint i
shop will remain at the site along with the possibility of retail use. The site must be rezoned to PD !
District to allow multiple land uses on the same site. Approximately 7570 square feet of the building '
space will be used by the charter school; 3100 square feet is available for retail space and 3100 square ,
feet will be used for the paint store on the 1.1 acre site.
I
Ingress to the site is from East North Street while egress is to the paved alley at the north of the site.
Adequate parking is provided on the site for all of the proposed uses. Classroom use requires less
parking than retail use so that if the school is expanded, adequate parking will still be available. '
The proposed mixed-use development(consisting of the school, the paint shop and retail space) is
compatible with the character of the surrounding area. The existing streets and existing utilities are
adequate to serve the site. Existing sidewalks along East North Street and North East Street serve the ',
site. The bus loading zone is located on East North Street.
POTENTIAL OBJECTIONS: There were no objectors to the request for a conditional use at the Plan I
Commission meeting.
INPUT FROM OTHER SOURCES: NA
STAFF REFERENCES: If Council members have questions they may contact Kathy Miller at 424-2786
or at kjmiller@decaturnet.org.
BUDGET/TIME IMPLICATIONS: NA
