Excerpts from City Plan Commission Minutes of August 1, 2002 <br /> Cal. No. 02-34 Petition of CITY OF DECATiJR for a Conditional Use Permit at 1155 <br /> SOUTH MARTIN LUTHER HING JR. DRIVE(City of Decatur South- ' <br /> west Water Treatment Plant). ,, <br /> Ms. Miller presented the recommendation of staff: <br /> The Water Treatment Plant was constructed in the late 1980s adjacent to Lake Decatur. Because <br /> of an oversight,a special use permit was never issued. A new addition to the treatment facility is <br /> being planned for lab and office expansion in addition to the recent addition of the nitrate <br /> removal facility. <br /> The petitioner wishes to operate and expand the water treatment facility at tHs site (zoned R-5 <br /> Two Family Residential District); the facility is necessary for the public convenience The use <br /> is compatible with the Urban Area Land Use Plan that shows the location as institutional. <br /> The water treatment facility and its additions are so located and designed to be operated in a <br /> manner that the public health, safety and welfare will be protected. The water treatment facility <br /> has not and will not cause substantial injury to the value of other properties in the neighborhood. <br /> A landscaping plan will be submitted and approved by the Economic and Urban Development <br /> Department before a Certificate of Occupancy for the building addition will be issued. <br /> Staff is of the opinion that the best interests of the City of Decatur would be served by approving <br /> the Conditional Use Permit for the water treatment facility in the proposed location. Staff <br /> recommends approval of the petition. - <br /> The Zoning Ordinance of the City of Decatur requires that conditional use requests be submitted <br /> to the Plan Commission for public hearing, study and report concerning the effect of the <br /> proposed use on the comprehensive plan and compliance with ordinance standards. A motion to <br /> forward the request of Cal. No. 02-34 to the City Council with a recommendation of approval is <br /> suggested. <br /> Mr. Richard Bernard of the Engineering Division was also present. <br /> Mr. Shampine asked why the conditional use rather than rezoning the property. Ms. Miller stated <br /> that the property is adjacent to residential zoning and the use can be allowed with a conditional <br /> use permit. <br /> There were no objectors present. <br /> It was moved and seconded(Smith/Shampine)to forward Cal. No. 02-34 to City Council with <br /> recommendation for approval. Motion carried. Commissioner Clevenger not present at the vote. <br />
