Motion carried with abstention by Commissioner Clevenger. <br /> C'al_ No. 02-26 Petition of ROBERT D. GRAVEN to rezone the premises at 375 <br /> NORTH 22nd STREET from B-1 Neighborhood Shopping District to <br /> B-2 Commercial District. <br /> Mr. Van Steenhuyse presented the recommendation of staff: <br /> The subject property cunently contains a used car business. According to the petitioner, this site <br /> has been a used car lot for the past eight years. The building was originally a Kentucky Fried <br /> Chicken restaurant. The site is accessed from a short extension of North Street located between <br /> North 22"d and the railroad right-of-way. <br /> The petitioner recently requested a Zoning Verification from City staff for operating a vehicle <br /> dealership. The staff determined that the prop�ty is in the B-1 Neighborhood Business District, <br /> which does not allow for automotive sales. In order for staff to certify that the property is zoned <br /> properly, it is necessary to rezone the property to B-2, Commercial District. The property is <br /> adjacent to B-2 zoning to the north. <br /> Mr. Van Steenhuyse noted that it is not unusual for small businesses to be established for a long <br /> time before the City is aware of a violation. In any case, it does not appear that the used car <br /> dealership at this location has had a negative effect on the general area. Although the B-2 <br /> District is less restrictive than the �1 District, the additional uses that would become permitted <br /> on this property are consistent with the uses allowed immediately to the north and those uses <br /> already established on East Eldorado Street. <br />
