� . �. � ? � � P�� � �' � <br /> WHEREAS, said portion of said streets are no longer useful to the public or to the City; <br /> and, <br /> WHEREAS, the public interest will be subserved by vacating said portion of said streets <br /> and the public will be relieved from the further burden and responsibility of maintaining the <br /> same. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section l. That the above described portion of said streets be, and the same are hereby, <br /> vacated as public streets inasmuch as the same is no longer required for public use and the public <br /> i��iterest will be subserved by such vacation, said portion of said streets being shown on the plat <br /> thereof hereto attached and hereby made a part hereof. <br /> Section 2. That the benefits which will be accrued to the owner of abutting property by <br /> reason of the vacation aforesaid is determined to be, in the judgment of the Council, equal to the <br /> sum of Eight Thousand,Nine Hundred-Fifty Dollars ($8,950.00). <br /> Section 3. That the vacation herein provided for is made upon the express condition that <br /> there shall be paid to the City of Decatur, Illinois, by St. Mary's Hospital only, the sum of <br /> $8,950.00 as compensation for the benefits determined as above set out herein, whereu�on such <br /> vacation shall become effective and title to said vacated right-of-way shall be vested in St. <br /> Mary's Hospital as provided by law. <br /> Section 4. That there is hereby reserved in, over, along and under the above-described <br /> portion of said streets to the City of Decatur, Illinois, and to the public and to those utilities and <br /> companies as the case may be owning public service facilities, mains, sewers, telephone and <br /> electrical or other public utilities, such property, rights of way and easements as aze or may be <br /> necessary or desirable for continuing public service by means of such facilities and for �he <br /> maintenance, renewal and reconstruction thereof with the right of ingress and egress for such <br /> purposes. <br />
