Decatur City Plan Commission <br /> Apri14, 2002 <br /> Page Six <br /> Based on this analysis, the Planned Unit Development meets all of the required standards of <br /> review. Further, staff is of the opinion that this project will both enhance the area and improve <br /> the economic climate of the community. Staff recommends approval of the petition as proposed, <br /> provided that development is also in accordance with the executed development agreement as it <br /> pertains to site development standards and development of infrastructure for dedication to the <br /> City of Decatur. <br /> Section 21, Paragraph C of the Zoning Ordinance provides that the commission shall hold a <br /> public hearing, review and make a recommendation to the City Council regarding Planned Unit <br /> Developments. A motion to forward this item to City Council with recommendation for <br /> approval is requested. <br /> Mr. Shampine asked if an exception from minimum zoning requirements is warranted. Mr. <br /> Bragg stated that the requirements under Planned Unit Development vary such as with the <br /> commercial development at Ash and Route 51. In 1991 the Plan Commission and City Council <br /> approved a similar blanket zoning which reverted back as nothing was developed. Mr. Bragg <br /> stated that the developer for the subject petition does not have a concrete plan yet as for facades, <br /> etc. The developer agrees to comply with all minimum standards. Staff will review submittals <br /> to see that the standards agreed upon are met. If there is a significant departure from the Planned <br /> Unit Development, it will be back before the Plan Commission and City Council. <br /> Mr. Phillip Cochran, Consulting Engineer, was present and spoke for the petition representing <br /> Real Estate Investors of Decatur(REID). Ed Flynn, Attorney, was also present. Mr. Cochran <br /> stated that a development agreement was entered into in April of 2001. In February of 2002 the <br /> preliminary plat of the subdivision was filed and approved by City Council. The Planned Unit <br /> Development is now also part of the developmerrt agreement. Mr. Cochran stated that staff is to <br /> be commended for working with the developer noting that there have been issues that he feels <br /> have been addressed. <br /> There were no objectors present. <br /> It was moved and seconded (Smith/Peck) to forward Cal. No. 02-16 to City Council with <br /> recommendation for approval. Motion carried unanimously. <br /> Cal. No. 02-09 Petition of STEPHEN SWANSON, Director of Engineering and Infra- <br /> structure of the City of Decatur, to vacate the alley behind the 2500 Block <br /> of North Main Street and sought of East Pythian Avenue. <br /> Ms. Miller presented the recommendation of staff: <br />
