Memorandum #02-43 April 12,2002 Page-2- Option 1 - Remove Sections 2 & 3 from the Temporarv Facilities section of the Ordinance • The current draft could be amended to remove the language from sections 2 and 3 from above. This would remove the expressed requirement tha.t these temporary facilities comply with the same set of parking and setback requirements imposed on permanent building owners/operators. Option 2 - Utilize the Zoning Board of Appeals (ZBA) • The ZBA could be utilized as the party to make decisions relative to whether or not a particular project should be allowed to vary from the requirements of the Zoning Ordinance. This is the current process utilized by every building applicant seeking a variance from the required elements of the Zoning Ordinance. As proposed in the . amended ordinance, the ZBA will consider requests to vary from parking and setback requirements.. City staff recommends Option 2 as it is consistent with current practice, and does not unfairly offer relief to a temporary facility that is not available to a permanent building/business owner.
