Memorandum #02-43 <br /> April 12,2002 <br /> Page-2- <br /> Option 1 - Remove Sections 2 & 3 from the Temporarv Facilities section of the Ordinance <br /> • The current draft could be amended to remove the language from sections 2 and 3 from <br /> above. This would remove the expressed requirement tha.t these temporary facilities <br /> comply with the same set of parking and setback requirements imposed on permanent <br /> building owners/operators. <br /> Option 2 - Utilize the Zoning Board of Appeals (ZBA) <br /> • The ZBA could be utilized as the party to make decisions relative to whether or not a <br /> particular project should be allowed to vary from the requirements of the Zoning <br /> Ordinance. This is the current process utilized by every building applicant seeking a <br /> variance from the required elements of the Zoning Ordinance. As proposed in the . <br /> amended ordinance, the ZBA will consider requests to vary from parking and setback <br /> requirements.. <br /> City staff recommends Option 2 as it is consistent with current practice, and does not unfairly <br /> offer relief to a temporary facility that is not available to a permanent building/business owner. <br /> City staff is asking Council members to respond either by phone or e-mail indicating their <br /> preferred option. <br /> STAFF REFERENCE: <br /> If Council members have questions they may contact A.J.
