The subject property is part of the Roosevelt School Apartments Residential Development Plan(RDP) approved by the City Council on March l, 2001 and amended in August. All of the properties included in the RDP were believed to have been rezoned under separate action by the City Council on 2/19/O1. However, the original petition for rezoning of these properties did not include the property in question. At the time of the original petition, the developers did not own the subject property. During the RDP approval process, they acquired the property and included it in the RDP eventually approved by Council. However, they failed to submit a petition to rezone the property. This was discovered later, as a result of due diligence by a potential lender.
