The subject property is part of the Roosevelt School Apartments Residential Development <br /> Plan(RDP) approved by the City Council on March l, 2001 and amended in August. All of <br /> the properties included in the RDP were believed to have been rezoned under separate action <br /> by the City Council on 2/19/O1. However, the original petition for rezoning of these <br /> properties did not include the property in question. At the time of the original petition, the <br /> developers did not own the subject property. During the RDP approval process, they <br /> acquired the property and included it in the RDP eventually approved by Council. However, <br /> they failed to submit a petition to rezone the property. This was discovered later, as a result <br /> of due diligence by a potential lender. <br />
