Excerpts from Plan Commission Minutes of October 4, 2001 <br /> Cal. No. 01-36 Petition of JIM ROMANO to vacate Alley Right of Way, West <br /> Towne Square, 900 BLOCK WEST WOOD <br /> Ms. Miller presented the recommendation of staff: <br /> The petitioner is requesting to vacate the alley right of way east of Oakland Avenue <br /> between 900 Block West Wood Street and 900 Block West Macon Street. A Planned Unit <br /> Development for Commercial Development was approved by the Plan Commission and City <br /> Council in December, 2000. An amendment is currently being reviewed at this site. <br /> The alley to the west of the current request was vacated in June, 1987 and April 2001. <br /> The petitioner wishes to vacate an additional portion of the alley for commercial development. <br /> The area will be parking; a turn around will be provided for utilities providing services to the <br /> residents east of the development <br />' have been received. An <br /> Mr. Romano owns the property on both sides of the alley. Utility letters <br /> easement for utility access and maintenance will be required. An appraisal for the proposed <br />' vacated right of way was submitted with an estimated market value of$700. <br /> This public right of way does not appear necessary to serve the general public; staff is of the <br /> opinion that the best interests of the City of Decatur would be served by approving the alley <br /> vacation request. Staff recommends approval of the alley vacation. <br /> Mr. Schiller asked about the address that was advertised. Ms. Miller stated that it was based on <br /> the address of the development and not at the site. <br /> Mr. Phillip Cochran, Consulting Engineer, was present to represent Mr.Romano and offered to <br /> answer any questions. <br /> There were no objectors present. <br /> It was moved and seconded (Smith/Anderson)to forward Cal. No. 01-36 to City Council with <br /> recommendation for approval. Motion carried at a vote of four to three with Commissioner <br /> Schiller abstaining from the vote. Those voting yea: Anderson, Peck,Setina and Smith. Those <br /> voting nay: John, Shampine and Washington. <br />
