' ` ' .' �� lfl5PG4b9 �-�, �,5'7 4 9 86 Sts1e of RNnoit I Hereby �„�,,,,�y ss cert�ry ThM This InetrulnlNtt Wat FRild Fpf R�K 3•30 PM 3EP E � 200� Recorded In Book3�Page46� Fee 21 �a p�Recorder ORDINANCE NO. 2001-68 AN ORDINANCE VACATING PORTION OF A STREET -EAST PEARL STREET- WHEREAS, a request has been received from Mark Allen requesting vacation by the City Council of a portion of East Peazl Street, said portion of said street being more particularly described as follows: That portion of the forty(40) foot wide right-of-way of Pearl Street lying North of and adjacent to Lots 9, 10, 11 and 12 of Block 3 of Gatling's Addition to the City of Decatur, as per Plat recorded in Book R Page 593 of the records in the Recorder's Office of Macon County, Illinois; and, WHEREAS, said portion of said street is no longer useful to the public or to the City; and, WHEREAS, the public interest will be subserved by vacating said portion of said street and the public will be relieved from any further burden or responsibility for maintaining said portion of said street. NOW, THEREFORE, BE IT ORDAINED, BY THE CTTY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the above described portion of said street be, and the same is hereby, vacated as a public street inasmuch as the same is no longer required for public use and the public interest will be subserved by such vacation, said portion of said street being shown on the plat thereof hereto attached and hereby made a part hereof. Section 2. That there is hereby reserved in, over, along and under the above-described portion of said street to the City of Decatur, Illinois, and to the public and to those utilities and companies as the case may be owning public service facilities, mains, sewers, telephone and electrical or other public utilities, such property, rights of way and easements as are or may be necessary or desirable for continuing public service by means of such facilities and for the maintenance, renewal and reconstruction thereof with the right of ingress and egress for such purposes.
