Excerpts from Plan Commission Minutes of June 7, 2001
Cal. No. 01-27 Petition of TONY ROMANO, 202 South Franklin Street, to rezone the
premises at the SOUTHWEST CORNER OF COUNTRY CLUB ROAD
and 44th STREET from R-2 Single Family Residence District to R-3
Single Family Residence District and for subsequent approval of an
R-3 Residence Development Plan.
Mr. Bragg presented the recommendation of staff:
The subject property contains 3.43 acres and is currently improved with a single family
residence. Properties to the west and south are in use for single family residences, while Lake
Decatur is located to the north of the site and the Decatur Country Club is located to the east. A
6"water main is available to the site from 44th Street and a 27" sanitary sewer connection is
available at Country Club Road. Access to the site is currently located at the southern edge of
the property along 44th Street. The petitioner proposes to construct seven three-unit
condominium structures on the site, totaling 21 units on the tract. Each building would
"step-down" the existing topography and would consist of three stories per building.
' Access would remain along 44th Street with no access to Country Club Road. The new
development would utilize a one-way circulation system, with ingress being at the south end of
the site, leading to an egress aligned with the existing Country Club exit. The entrance would be
gated for limited access. All circulation drives and parking would be privately owned and
maintained. The petitioner proposes to capture storm water from the development into a private
storm sewer system that flows into the detention basin at the north end of the property. The
detention basin would then outlet into the existing public storm sewer.
The petitioner proposes to create a density of approximately 1 dwelling unit per 7,100 square feet
of gross land area. Staff finds the proposed density to be of low-density for multiple dwelling
development and generally consistent with the density of the surrounding area. Under current
zoning on the site, a total of 15 single family units could be constructed, creating a density of 1
dwelling unit per 9,900 square feet of gross area. Existing utility services are adequate to
provide service to the proposed development.
The proposed multiple family use will generate fewer trips per day than as a single family R-2
development as it is currently zoned. Staff has consulted the City Engineer regarding traffic
generation from the site and has confirmed that the proposed use will not generate a noticeable
impact on traffic counts along 44th Street, which currently carries approximately 550 vehicles
per day. Staff is also of the opinion that Country Club Road would be insufficient for
ingress/egress to the site based on site distance issues associated with that section of the roadway.
Staff finds the proposed use to be consistent with the goals of the Decatur Urban Area Land Use
Plan. Further, staff believes that the proposed development will enhance the area. Staff
recommends approval of the petition as submitted.
Mr. Phillip Cochran, Consulting Engineer, was present and spoke for the petition representing
Jim and Tony Romano who were also present. Mr.Cochran stated that the property and project ',
are as described by staff. He stated that the property is unique with a 45 foot elevation from the
