M ller, AICP, Planner� ' <br /> SUBJECT: Alley Vacation--East of Oakland Avenue <br /> between West Wood Street and West Macon Street on Petition of Jim Romano � <br /> SiJMMARY RECOMMENDATION: Staff recommends approval of the alley vacation. The <br /> Plan Commission reviewed the request at the April 5 meeting and recommended approval with a <br /> vote of 7 to 0. Plan Commission Minutes are attached. <br /> BACKGROiJND: Most of the property was rezoned from R-6 to B-2 and, at the same time a <br /> Planned Unit Development for Commercial Development was approved by the Plan Commission <br /> and City Council in December, 2000. It was noted on the site plan that this alley would be <br /> vacated. It was also noted in the ordinance that the Petitioner shall petition to vacate the alley <br /> segment prior to applying for any permits. The application was filed as stipulated; the permits <br /> were issued; the site is under construction. <br /> The alley to the east of the current request (for 205 feet) was vacated in June, 1987. The <br /> petitioner wishes to vacate the remaining portion of the alley just east of Oakland Avenue. <br /> POTENTIAL OBJECTIONS: There were no ob'ectors at the Plan Commission meetin . <br /> J g <br /> INPUT FROM OTHER SOURCES: Utility letters have been received: Ameritech requested <br /> an additional easement on the development site, but not in the alley right of way. All electrical <br /> services previously located in the alley right of way will be relocated at the expense of the <br /> developer. A ten inch sewer line located in the alley will also be relocated. Insight <br /> communication has no cable television line in the alley right of way. <br /> STAFF REFERENCES: If Council members have questions they may contact Kathy Miller at <br /> 424-2786. <br /> BUDGET/TIME IMPLICATIONS: An appraisal for the proposed right of way for vacation was <br /> submitted with an estimated market value of$200. <br />
