' P`age 2 of 2 I
2455 East Pershing Road
April 5, 2001 ,
d. The access drive to the parking shall be 24 feet in width ar two 12 feet directional drives. '
3. The subject property contains a 14,000 square foot lot. The property is improved with a
single-family detached residence structure. The property is bounded by residential uses on the
south, west and east sides. City water and sanitary sewer services are available to the site.
Access is currently available from Pershing Road & also available from N. 25"' Street.
4. There have been several recent O-1 rezonings to the east (27`h and Pershing). The most recent
rezoning was in July, 2000.
PROJECT DESCRIPTION
5. The petitioner has amended her petition to rezone one lot totaling .321 acres, to O-1, Office
District. The petitioner has indicated that the lot will be used for Office use and will house an
EEG lab (clinic to test brain waves).
STAFF ANALYSIS
6. As mentioned in the last staff report, the property owner does not own the adjacent property
which lies to the west of the subject property. The existence of the lot to the west divides the
existing B-2 and proposed O-1 districts. Therefore, rezoning the subject property could still be
construed as spot zoning.
7. The proposed rezoning is not compatible with the adjacent Low-Density Residential uses in the
area, particularly the single-family lot to the west that separates the property from existing
commercial zoning.
8. Although the proposed use may not negatively impact the neighboring properties,
considerations must also be given to any other use that could be allowed if the property is
rezoned to O-1.
STAFF RECOMMENDATION
9. Although staff continues to have concerns about this rezoning, it is consistent with earlier
approvals on the same street. The O-1 District is less intrusive than the originally proposed
B-1 and provides adequate screening for the surrounding residential uses. Therefore, staff does
not object to the proposal.
The above report constitutes the testimony and recommendation of the Planning Division,
Economic and Urban Development Department, City of Decatur.
Joselyn A.
