WHEREAS, a Permanent Easement is desired and necessary for the improvement, <br /> extension, construction and maintenance of the Hickorywood Storm Sewerage System and to <br /> enter therein or thereon at such time or times said City shall deem necessary for said purposes on <br /> the premises described as: <br /> Commencing at the Northeast corner of Lot 13 of Hickory Point Manor, as per <br /> Plat recorded in Book 300 Page 243 of the records in the Recorder's Office of <br /> Macon County, Illinois, thence South along the East line of Lot 13 15.00 feet <br /> (4.57 m) to the POB, thence West a distance of 120.00 feet (36.58 m) and parallel <br /> to the North property line of Lot 13, thence Southeast to a point on the East <br /> property line said point being 17.00 feet (5.18 m) South of the POB and thence <br /> North to the POB; and, <br /> WHEREAS, the above-described easements are both located on properly commonly <br /> referred to as 250 Hickorywood Drive, Decatur, Illinois; and, , <br /> WHEREAS, the im rovement, extension, construction and maintenance of the <br /> P <br /> Hickorywood Storm Sewerage System will be useful, advantageous and desirable for the City of <br /> Decatur and the public welfare therein; and, <br /> WHEREAS, Eminent Domain is permitted for such purposes under 65 ILCS 5/11-61-1 <br /> et. seq., 65 ILCS 5/11-139-12 and the City of Decatur's Home Rule Authority. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section l. That it is, and it is hereby determined to be, necessary and desirable that the <br /> City, in order to improve, extend, construct and/or maintain its storm sewerage system as <br /> aforesaid, acquire a Temporary Easement and a Permanent Easement to the real property <br /> described above. <br /> Section 2. That it is hereby determined that the aforesaid Temporary Easement and <br /> Permanent Easement, and the acquisition thereof, are necessary for a public use and purpose. <br />
