7 � <br /> ORDINANCE NO. 2001-01 <br /> ORDINANCE AUTHORIZING THE BORROWING OF FUNDS <br /> FROM THE PUBLIC WATER SUPPLY LOAN PROGRAM <br /> WHEREAS, the City of Decatur, Illinois ("Cit�') operates a public water supply system <br /> (the "System"), and is a home rule unit in accordance with the provisions of Article VII §6 of the <br /> Illinois Constitution; and <br /> WHEREAS, the City Council of the City has determined that it is advisable, necessary <br /> and in the best interests of public health, safety and welfare to improve the System, including the <br /> following: <br /> The South Water Treatment Plant will be modified by the addition of a nitrate <br /> treatment facility, which will reduce nitrates in treated water below the m�imum <br /> concentration level allowed by the United States Environmental Protection <br /> Agency. The treatment facility will consist of certain mechanical equipment, <br /> including ion exchange tanks, and the useful life of said equipment varies from <br /> twenty(20) to fifty(50)years, <br /> together with any land or rights in land and all electrical, mechanical or other services necessary, <br /> useful or advisable to the construction and installation (the "Project"), all in accordance with the <br /> plans and specifications prepared by consulting engineers to the City; and, <br /> WHEREAS, the estimated cost of constructing and installing the Project, including <br /> engineering, legal, financial and other related expenses, is $9,500,000.00, and there are <br /> insufficient funds on hand and lawfully available to pay these costs; and, <br /> WHEREAS, the costs are expected to be paid for with a loan to the City from the Public <br /> Water Supply Loan Program through the Illinois Environmental Protection Agency, the loan to <br /> be repaid from revenues of the System, and the loan is hereby authorized to be accepted at this <br /> time pursuant to the City's home rule authority; and, <br />
