v <br /> . � � <br /> T� � � <br /> ORDINANCE NO. 2000-102 <br /> ORDINANCE ESTABLISHING AND LEVYING A SERVICE CHARGE <br /> FOR CURBSIDE LEAF VACUUMING AND DISPOSAL <br /> WHEREAS, the City of Decatur is a home rule unit of government under the provisions <br /> of the Constitution of the State of Illinois; and, <br /> WHEREAS, the Council of said City has decided that it would be in the public interest to <br /> establish a curbside leaf vacuuming program whereby citizens would have the opportunity to <br /> have leaves vacuumed and collected at their homes and residences; and, <br /> WHEREAS, the Council, pursuant to said curbside leaf vacuuming program, has <br /> authorized a contract with Suburban Disposal and Recycling, Inc. ("leaf vacuuming contractor") <br /> for the collection of leaves from all dwellings within the City; and, <br /> WHEREAS, Chapter 56.2 of the City Code authorizes the imposition of a service chazge <br /> on the owners of all dwellings within the City, said service charge to reimburse the City for its <br /> contractually-obligated payments to the leaf vacuuming contractor and to provide for other leaf <br /> vacuuming related expenses; and, <br /> WHEREAS, the City's above-referenced contract provides that the City will pay the leaf <br /> vacuuming contractor the sum of Four Hundred Three Thousand Two Hundred Dollars <br /> ($403,200) per year, the leaf vacuuming contractor being obligated by such contract to collect <br /> leaves from each dwelling within the City; and, <br /> WHEREAS, the Council finds that the City's expenses for the first year of leaf <br /> vacuuming should be paid from current funding sources, but that the remaining years of said <br /> contract, and other expenses related thereto, should be paid through the imposition of a service <br /> charge upon the owners of all dwellings within the City; and, <br /> WHEREAS, the Council finds that the sum of One Dollar and Twenty Cents ($1.20) per <br /> month from each dwelling within the City is necessary to defray contractual and other expenses <br /> related to leaf vacuuming for the remaining years of said contract. <br />
