Krieger ssistant City Manage <br /> Dane Bragg, lanner� <br /> RE: Rezoning 2029 North Water Street from R-3 to B-1 <br /> The petitioner is requesting the rezoning of a 10,800 square foot, or 0.25 acre, parcel from R-3, <br /> Single Family Residence District, to B-1, Neighborhood Shopping District. The property is <br /> illustrated as Low Density Residential Development on the Decatur Urban Area Land Use Plan. <br /> Property to the north, west and east is zoned R-3 and developed as such. There is a church <br /> located immediately west of the subject property. Property to the south is zoned B-1 and <br /> developed with an office building. The property currently has water and sanitary sewer service <br /> available. The petitioner has indicated that the property would be used as an office. <br /> This tract is located in an area currently being targeted as a part of a corridor study for the U.S. <br /> 51 and Route 36 corridors in Decatur. This study is expected to provide insight into land use <br /> regulation and aesthetic controls along the vital traffic arteries of the City. <br /> This property is located in The Elms, which is an established residential neighborhood. Staff is <br /> of the opinion that rezoning into this area may have a deleterious effect on the neighborhood. <br /> This area has remained a stable, vital and aesthetically attractive neighborhood up to now, and <br /> staff sees no indication that changes in zoning would improve the area's overall condition. <br /> Similar petitions requesting rezonings in this corridor have been denied by both the Plan <br /> Commission and the City Council. The last rezoning approved in the immediate area was the <br /> Family Video rezoning to B-1, which was approved by City Council in April of 1999. Although <br /> O-1 zoning may be more appropriate to the applicant's proposed use, staff does not recommend <br /> the use of this zoning because it would create a spot-zone. <br /> Staff is of the opinion that this petition mirrors the petition for rezoning at 2456 North Main <br /> Street in that it presents a one-lot rezoning, adjacent to a B-1 district, within an established <br /> neighborhood along the 51 corridor. The petition at 2456 North Main Street was denied <br /> unanimously by City Council on June 19, 2000. <br /> Staff fails to see a benefit to the area that would be established by rezoning the subject property. <br /> Staff recommends denial of the petition as proposed. <br /> Page 1 <br />
