. , - .
inconvenience. He stated that there would be more blacktop and a larger roof with no space for
water retention.
Mr. Heavner stated that the distance from the drive through to the property line would be 50 feet
and the distance from North Street to the drive through is 120 feet. The distance from the
speaker would be 80 feet to Mr. Allison's property. A six foot fence will be constructed to block
the lights and the noise. A six foot brick structure houses the dumpster. Petitioner is agreeable to
moving the location of the garbage.
Mr. Heavner stated that the purpose of the city's recent restructuring is to encourage
development. He stated that the proposed restaurant will be a newer facility with a safer traffic
pattern. Petitioner worked with staff so that the residents could use the alley to get into their
garages and to turn around and get back out. Mr. Heavner stated that Mr. Forgey visited the site
several times and reviewed the proposals from every angle. The area is paved and will not create
a drainage problem.
Mr. Allison asked that the Commission override staffs recommendation and vote no on this
petition.
Mr. Forgey presented the recommendation of staff:
The applicant seeks to rezone four lots adjoining the current McDonald's restaurant from R-5,
Two Farruly Residence District, to B-2, Commercial District, to allow the replacement of the
current restaurant with a new facility and improved traffic circulation. The property is illustrated
on the Future Land Use Map, a component of the Decatur Comprehensive Plan, as "Commercial."
Staff has conducted several visits to this site and concludes that the proposed changes to the site
will, if approved, greatly improve the appearance of Eldorado Street. Staff therefore recommends
approval of this petition as proposed.
Mr. Setina asked if there would be a fence across the south property line to keep lights from
shining on other property. Mr. Sharp stated that there were currently no plans for a fence on that
property line but there would be no problem with constructing o,ne. The lot lights shine inward.
Mr. Schiller asked if there would be additional site plan approval if this petition were approved.
Mr. Forgey stated that the applicant would work with staff. Staff is viewing this petition as an
appropriate land use and the principal purpose is to review the land use and the merits of
rezoning.
Mr. Shampine stated that the proposal will be safer.
It was moved and seconded (Shampine/Jacobs)to forward Cal. No. 00-26 to City Council with
recommendation for approval. Motion carried with Commissioner Smith abstaining from the
vote.
