COMMUNITY DEVELOPMENT MEMORANDUM
No. 00-29
Februa 2, 2000
rY
TO: Honorable Mayor Terry M. Howley and City Council Members
/
FROM: Steve Garm y Manager
Cecil A. Collins Jr., Director of Community Developr`Cent, Planrung and Transit
Kathy J. Miller AICP, Planner v`.
SUBJECT: Easement Vacation Country Acres Addition(Holy Cross Lutheran Church)
East-West Easement between Lots 1 and 16, 2 and 15, 3 and 14
and North-South Easement between Lots 1, 16 and 2, 15
A valid request has been received from the property owner adjoining the subject easement to i
vacate the same to construct an addition to the esting church. Inasmuch as the easement in
question serves only the adjoining property, staff is of the opinion that said easement is no longer
necessary to serve the general public and that best interests of the City of Decatur are served by
approving the vacation request.
All appropriate utility companies and franchise holders are willing to release this portion of the
platted easement. No compensation is necessary.
Staff recommends approval of the proposed easement vacation as submitted.
