99-96 APPROVING A SECOND SUPPLEMENT TO LEASE AGREEMENT

' r` resolution of the Corrunission in return for a sum sufficient to redeem the Series 1986 Bonds on January 1, ?000 and to produce additional sums for the Commission, the County and the City; and `VHEREAS, it is necessary that the County and the City approve the form of the Second Supplement ta Lease A�reement (the "Second Lease Sccpplement") with the Commission in order to pernut the issuance of the Series 1999 Bonds; and �VHEREAS, the Series 1999 Bonds will be secured by rental payments under the Second Lease Supplement payable solely and only from the receipts on the Government Securities to be held bv �1a�na Bank under an escrow agreement; and ��'HERE�S, the Council has been provided with a draft form of Preliminary Official Statement �vhich describes the Series 1999 Bonds and the necessary transactions in connection there�L-ith; and WHEREAS, the Cauncil has received and revie�ved the form of the Second Lease Supplement anc3 the draft form of the Preliminary O�cial Statement; and WHEREAS, it is necessary and in the best interests of the City that the transaction, as described in the draft form of Preliminary Official Statement,be consummated. NOW, THEREFORE,BE IT ORDAINED by the Ciry of Decatur,Macon County, Illinois, as follows: Section 1. The Council authorizes and approves the Mayor's execution on its behalf of � the Second Lease Supplement in substantially the form attached to this Ordinance, and with the � amounts of the rentals to be inserted to reflect the sale of the Series 1999 Bonds, with such chanQes therein as may be approved by the officer of officers of the County, the City, and the �', Commission executing the same, his, her or their e�ecution thereof to constitute conclusive ', --2-
