� <br /> ORDINANCE NO. 99-93 <br /> AN ORDINANCE ESTABLISHING AND LEVYING A SERVICE CHARGE <br /> FOR THE COLLECTION OF RECYCLABLE MATERIALS <br /> WHEREAS, the City of Decatur is a home rule unit of government under the provisions <br /> of the Constitution of the State of Illinois; and, <br /> WHEREAS, the Council of said City has decided that it would be in the public interest to <br /> establish a comprehensive recycling program whereby citizens would have the opportunity to <br /> have recyclable materials collected at their homes and residences; and, <br /> WHEREAS, the Council, pursuant to said comprehensive recycling program, has <br /> authorized a contract with Suburban Disposal and Recycling ("recycling contractor") for the <br /> collection of recyclable materials from all dwellings within the City; and, <br /> WHEREAS, Chapter 56.1 of the City Code authorizes the imposition of a service charge <br /> on the owners of all dwellings within the City, said service charge to reimburse the City for its <br /> contractually-obligated payments to the recycling contractor and to provide for other <br /> recycling-related expenses; and, <br /> WHEREAS, the City's above-referenced contract provides that the City will pay the <br /> recycling contractor the sum of$1.40 per month for each occupied dwelling within the city, the <br /> recycling contractor being obligated by such contract to collect recyclable materials from each <br /> such dwelling. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That all words and phrases used in this Ordinance that are defined in Chapter <br /> 56.1 of the City Code shall have the meanings ascribed to them in said Chapter, otherwise to <br /> have their plain and ordinary meanings. <br />
