r ORDINANCE NO, 99-84 ORDINANCE AUTHORIZING DESIGNATION OF CITY AS PRIMARY RESCUE/RESPONSE PROVIDER WHEREAS, in the Memorandum of Understanding approved by this Council by Resolution No. R98-48 ("Memorandum"), the City agreed to provide written confirmation of the City's willingness to be designated as the primary provider for hazardous response, confined space and trench rescue services for the entities which were parties to said Memorandum, upon receipt by the City of the financial and in-kind contributions specified therein; and, WHEREAS, in the judgment of Council, sufficient financial and in-kind contributions have been pledged by the parties to said Memorandum to meet the spirit and intent thereof, and the City should therefore provide to said parties said written confirmation, on the conditions set out herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS. Section 1. That the City Manager and the Fire Chief be, and they are hereby, authorized and directed to provide to the parties to the Memorandum such written confirmation regarding the provision of various safety and rescue services as is called for therein, on the conditions set out below and as approved by the City's Corporation Counsel. Section 2. That the written confirmation referred to in Section 1 hereof shall be provided as specified therein, stating that the City shall perform the described safety and rescue services for the parties to said Memorandum,but only for that period of time corresponding to the amount actually deposited with the City by said parties, as follows: $250,000 One (1) year of service next $150,000 One (1) additional year of service final $100,000 One(1) final year of service If the total amount due for all three (3) years is not paid prior to the issuance of the first written confirmation, additional confirmations will be issued as each funding increment is deposited. The first written confirmation will be effective sixty(60) days after the first funding increment is deposited and all safety and rescue information requested by the Fire Chief from each party is received by the City.
