A � � i <br /> x <br /> ORDINANCE NO. 99-50 <br /> ORDINANCE AMENDING CITY CODE <br /> - CHAPTER 34 - <br /> - TRAFFIC - <br /> BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS: <br /> Section 1. That Chapter 34 of the City Code of the City of Decatur be, and the same is hereby, <br /> amended and modified at Sections 77, 79 and 81 thereof, so that said Sections 77, 79 and 81, as <br /> amended, shall provide as follows: <br /> 77. PENALTIES. <br /> A. Any person, firm or corporation in whose name a citation alleging a violation <br /> enumerated in Section 80 of this Chapter is issued, and who shall neglect or refuse to pay <br /> such citation after written notice, shall be indebted to the City of Decatur in the amount <br /> specified in Section 80, unless and until a complaint is filed in the Circuit Court. <br /> B. Debts for unpaid citations alleging violations of this Chapter may be referred <br /> to a qualified private enterprise for collection. In the event an unpaid parking citation is <br /> referred for collection, the City Finance Department may assess an additional fee of Five <br /> Dollars ($5.00) per violation. No citation shall be referred for collection before written <br /> notice, directed to the registered owner of the illegally parked vehicle is attempted by the <br /> City. No citation shall be referred for collection if there is pending an appeal of the <br /> citation. <br /> C. In the event the City brings legal action for the enforcement of any provision <br /> of this Chapter, the Office of the Corporation Counsel may assess a fee of Twenty-five <br /> Dollars ($25.00) if settlement is reached prior to initial court appearance and Fifty Dollars <br /> ($50.00) if settlement or judgment is obtained after a court appearance. This fee shall be <br /> in addition to any other fines, fees, penalties or costs as provided by this Ordinance or <br /> State Law. <br />
