Miller, Planne���� <br /> � <br /> SUBJECT: Ordinance Rezoning Property Generally Located at the Intersection of <br /> Route 48 and Route 105 and Granting a Special Use Permit <br /> The subject petition requests that a parcel of land generally located at the intersection of Route 48 <br /> and Route 105 be rezoned from R-1 Single Family Residence District to B-2 Commercial District; <br /> petitioner further requests the approval of a Special Use Permit to operate a Paintball Amusement <br /> Center. The area in question is currently vacant land located south of the Sangamon River within <br /> the corporate limits of the City of Decatur. Previous to annexation, the property was zoned M-1 <br /> by the county. <br /> Upon review of land use and zoning patterns for the general area, staff notes that property <br /> immediately to the north, south and west are zoned B-1 Neighborhood Shopping District or B-Z <br /> Commercial District and developed as such. Area to the east is zoned M-1 Light Industrial <br /> District. The 99 Club, located outside the city limits is zoned commercial by the county. Staff is <br /> of the opinion that the proposed zoning is consistent and compatible with zoning patterns in the <br /> general area and with the Comprehensive Land Use Plan which designated this area as <br /> commercial use. <br /> Staff recommends approval of the petition for rezoning and a Special Use Pernut; however, a <br /> building permit will be required if any structures are constructed and a permit will be required <br /> from IDOT if additional access is required. In addition, no building permit will be issued to build <br /> below an elevation of 610 feet and no landscape fill can occur without compensatory storage and <br /> the proper permits. <br />
