No. 99-09 Petition of DAVID STERN for approval of a Revised Residential Planned <br />� Unit Development located at 2440-2442 Wakefield Drive. <br /> Mr. David Stern was present and spoke for the petition stating that he plans to construct an <br /> addition on the back of the structure. The downstairs will be expanded to a third unit as it has <br /> been used for some time. A deck was removed and there will be the addition of a small deck and <br /> sun porch. <br /> Mr. Demirjian questioned if there was adequate parking for the expansion. Mr. Stern stated that <br /> there are two, two-car gaxages and two, two-car driveways. All parking is located offthe street. <br /> There were no objectors present. <br /> Mr. Forgey presented the recommendation of staff: <br /> The property is located at 2440-2442 Wakefield Drive, Apartments 1 & 2. The zoning for this <br /> property is R-3, which is a single-family zone. Duplex zoning, which e�sts on the site, is <br /> ordinarily permitted only in R-5 and R-6 zones, unless they are allowed as a part of an approved <br /> Planned Unit Development (PUD). In this particular case, the duplex units have clearly e�sted <br /> for many years and must have been allowed under the terms of a PUD. No record of the original <br /> PUD can be found. The duplex is consistent with neighboring uses. This is not an ideal situation, <br /> but the action requested by the applicant--i.e. a PUD amendment allowing the existing use to <br /> continue without amending the zoning designation on the site is a common-sense solution. <br /> Staff recommends approval of the petition as proposed. <br /> It was moved and seconded (Schiller/Setina)to forward Cal. No. 99-09 to City Council with <br /> recommendation for approval as presented. Motion carried unanimously. <br />
