( y � ORDINANCE NO. 98-63 AN ORDINANCE AMENDING B-3 PLANNED SHOPPING CENTER DISTRICT -FRANKLIN STREET AND ROUTE 51 - WHEREAS, on the 1 st day of October, 1998, upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of the Decatur Park District to amend the B-3 Planned Shopping Center District previously established as to premises within that District and described as: Lot 16 in Block 4 of Third Rolling Mills Addition to the City of Decatur, as per Plat recorded in Book 50 Page 380 of the records in the Recorder's Office of Macon County, Illinois; and, WHEREAS, the Decatur City Plan Commission recommended that said modification and amendment be granted. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the recommendation of the Decatur City Plan Commission be, and the same is hereby,received,placed on file and approved. Section 2. That upon the conditions set forth in Section 3 hereof, the aforesaid B-3 Planned Shopping Center District be, and the same is hereby, modified amended and Petitioner be, and it is hereby, permitted to develop and use the above described property as shown on the Site Plan attached hereto and hereby made a part hereof. Section 3. That said modification be, and the same is hereby, expressly conditioned as follows: (a) That Petitioner receives all necessary permits from the Illinois Department of Transportation, including permission for all jurisdictional transfers of roads.
