Excerpts from Plan Commission Meeting of October l, 1998
Cal. No. 98-61 Petition of NANCY KLEBE to rezone the premises commonly known as
1170 East Orchard from R-3 Single Family Residence District to B-1
Neighborhood Shopping District.
Mr. Jerome Pelz, Interim Administrator of St. John's Lutheran Church, was present and spoke for
the petition. Mr. Pelz stated that in January, the school relocated from this location. The
property is to be sold and rezoning is needed in order to allow the use of the premises for the
same purpose. The building has been a school since 1954. Mr. Pelz stated that the prospective
" buyer wants to use the facility for a day care. He noted that there are residences to the north of
this location but all other surrounding uses are social services.
Mr. Shampine questioned if the existing building was to be demolished. Mr. Pelz stated that the
existing building would be used for the day care.
There were no objectors present.
Mr. Forgey presented the recommendation of staff:
The subject petition, on behalf of St. John Evangelical Lutheran Church, requests rezoning of '
Lots 11 through 20, inclusive, of Block 18 and Lots 1 through 10, inclusive, of Carver's Addition '
to the City of Decatur from R-3 Single-family Residential to B-1, a commercial designation. The '
address is 1170 East Orchard. The stated purpose of the rezoning is to use the property as a day
care center and school.
There is a miure of uses and zoning categories in this neighborhood. There is R-3 to the north
and west, B-1 and R-6 to the east. The block to the south is mostly zoned R-3, but with a B-1
spot in the eastern third of the block. Any rezoning, whether to B-1 or a less intensive category,
such as O-1 or R-6 would create an incursion into a single-family zoned area.
There is simply too little information contained in this application to justify a rezoning this drastic.
A day care center can be built on this site with R-6 zoning. Staff is concerned that this petition, if
granted, would place stress on an existing single-family neighborhood, and therefore, recommends
denial of the petition.
Mr. Schiller questioned what was stated in the Comprehensive Land Use Plan. Mrs. Townsend
stated it currently reflects institutional use because of the school.
Mr. Pelz stated that parking would be to the west as there are no houses on that side. He noted
there are no residences to the south and only five houses to the north. The impact of traffic
would be less than it has been in the past.
Mrs. Townsend stated that petitioner can request downzoning from the floor. Mr. Pelz stated
that was what he wanted to do.
