_ r . ` (2) An�person who at the time of disposal, transport, stora�e, or treatment of hazardous materials or environmentall�a�g substances owned or �erated the facilitv or vehicle used for such disposal,transnort treatment or from which there was a fire, release or threatened release of such hazardous materials or environmentallv dama i�n�substances: (3) Anv person who bv contract, a�reement or otherwise has arran ed with another pariv or entitv for transport, stora e, disposal or treatment of hazardous materials or environmentally dama in� substances owned, controlled or possessed b s�ch person at a facility owned and operated bv another partv or entitv from which there is fire, release or threatened release of hazardous materials or environmentallv damaging substances; (4) An�person who accepts or acce tn ed anv hazardous materials or environmentall�dama�� substances for transport to disposal, stora e or sites from which there is a fire,release or threatened release of hazardous materials or environmentall,�ging substances; (5) In the case of an abandoned facilitv or vehicle anv person ownin� operatin�the abandoned facili or an�person who owned or operated or otherwise controlled activities at the abandoned facilitv immediatel�nrior to abandonment: (6) In the case of a land trust ownin or operatin�a facilitv or vehicle the nerson owning the beneficial interest in the land trust. 2. UNLAWFUL RELEASES PROHIBITED. No person shall cause threaten. or allow the release of hazardous materials or environmentallv dama�� substances, unless such release is in accordance with an appropriate permit �ranted bv the Illinois Environmental Protection A e�ncy or other State or Federal a e�nCX havin�primarv authoritv over the release and such release is in such a place and manner as will not create a substantial present or potential hazard to human health,property, or the environment. Anv prohibited release is herebv declared a public nuisance.
