Excerpts from Plan Commission Meeting Minutes of August 6, 1998
Cal. No. 98-41 Petitioner of BRIAN McLEMORE to rezone the premises commonlv
known as 3342 North Charles Street from R-1 Single Famiiy Residence
District to M-1 Light Industrial District.
Mr. Elmore Hawkins, Attorney, was present and spoke for the petition representing Mr.
McLemore. Mr. Hawkins stated that the subject property is sunounded by M-1 zoning to the
north, east and south. Petitioner cannot continue to live in their house at this location since the
car wash was constructed behind them that makes constant noise.
There were no objectors present.
Mrs. Townsend presented the recommendation of staff:
The subject petition requests that the premises commonly known as 3342 North Charles Street be
rezoned from R-1 Single Family Residence District to M-1 Light Industrial District. Containing
appromately 1 acre, the area in question is presently developed with a single family residence.
The purpose of the proposed zone is to a11ow the petitioner to use the premises for the storage of
boats and travel trailers.
Inasmuch as property to the immediate north, south and west are presently zoned M-1 Light
Industrial District, staff is of the opinion that the proposed zoning is consistent and compatible
with zoning patterns in the general area. Further, the Comprehensive Land Use Plan designates
this tract and adjoining tracts as Light Industrial District. However, the intended use of the
property is not permitted within a M-1 Light Industrial District. The storage of boats and travel
trailers are permitted within a M-2 Heavy Industrial District with a special use permit.
In view of the data presented, staff recommends approval of the M-1 District however, the zoning
will not permit the intended petitioner's use of the property.
Mr. Hawkins stated that the petitioner is aware that the intended use would not be allowed in the
M-1 zoning classification and will use the property in another way that meets the criteria.
It was moved and seconded (Schiller/Shampine) to approve Cal. No. 98-41 per staff
recommendation. Motion carried unanimously.
