Excerpts from the 7une 4, 1998 Decatur City Plan Commission Minutes
Cal. No. 98-30 Petition of EAST PERSHING OFFICE PLAZA to rezone the premises
located at the southwest corner of Pershing Road and 27th Street from
R-1 Single Family Residence District to O-1 Office District.
Mr. Robert Wesselink of Blank, Wesselink and Cook was present and spoke for the petition
stating that there is an agreement for the sale of the property which is based on the rezoning.
There is an O-1 use to the west of this property and across the street and to the east there is M-1
zoning. Mr. Wesselink stated that the proposed use is compatible with the Land Use Plan.
There were no objectors present.
Mr. McQueen presented the recommendation of staff:
The subject petition requests that a tract of land located at the southwest corner of East Pershing
Road and North 27th Street be rezoned from R-2 Single Family Residence District to O-1 Office
District. The area in question contains approximately 2.5 acres and there is presently a vacant
house on the tract of land. As reported by petitioner, the purpose of the proposed zone is to
accommodate construction and operation of a new office building.
Upon review of land use and zoning patterns for the general area, staff notes that property to the
immediate west is zoned in part O-1 Office and in part R-2 Single Family with both areas being
accordingly developed. Property to the north across Pershing Road is vacant and zoned M-2
Heavy Industrial with property to the east across 27th Street being zoned M-2 and occupied by
Caterpillar Tractor Company. Adjoining land to the south is zoned R-2 and developed with a
church. '
Recognizing these existing land use and zoning patterns and particularly the adjoining O-1
classification, staff is of the opinion that the proposed zone is consistent and compatible with the
general area. Further, we note that the lots in questions were at one time zoned M-3 limited
Industrial District; however, the zone classification reverted to single family due to the lack of
development of the premises.
Lastly, the Comprehensive Land Use Plan calls for the area in question to be office development.
In view of the data presented, staff recommends approval of the petition.
Mr. Shampine stated that a previous petition was spot zoned and he had voted against the
petition. He stated that in clear conscience he cannot vote for the O-1 use of this property with a
residence neto it. Mr. Shampine would be more comfortable if the petitioner had brought a
plan to the Commission.
