1
COMMUNITY DEVELOPMENT MEMORANDUM
NO. 98-10
February 24, 1998 —

TO: Honorable Mayor Terry M. Howley and
City Council Members
FROM: 7ames L. Williams , City Manager
Cecil A. Collins, 7 ., Community Development Director
Robert A. McQueen, Senior Planner'
SUBJECT: Vacation of public walkway adjacent to 320 South Lake Shore Drive.
A request has been received from the two property owners adjoining the public walkway in
question to vacate the same; the purpose of the proposed vacation is to allow this tract to be
incorporated into yard area for the adjoining two residential lots.
The subject walkway was never developed as such and has actually served as yard area for the
petitioners esting single family homes. Consequently, it has been maintained by the adjoining
owners and has no appearance as being public property. Due to the drop in topography from the
east end of this walkway to Lake Decatur, considerable work would be necessary for this tract to
be utilized by the public.
Inasmuch as this walkway was never developed as such, that public access to Lake Decatur ests
approximately four hundred feet to the north and south thereof, and in consideration of the
topography as noted, staff is of the opinion that said walkway is not necessary in terms of serving
the general public; furthermore, the best interests of the public would be served by vacating the
same.
The petitioner submitted from a qualified appraiser a value of $1600.00 for the subject property,
which is a ratio of$1.50 per square foot.
Staffrecommends approval of the proposed vacation as presented.
