. � <br /> -2- ' <br /> liens. Seller agrees to pay for transfer tax stamps, prepare the real estate <br /> transfer declaration form and any environmental disclosure requireaent <br /> documents. Buyer agrees to pay for the cost of recording with the Recorder of <br /> Deeds any of the docu�ents necessary to complete the transfer of ownership. <br /> b. At or before settlement Selier shall pay for and give Buyer credit <br /> for general real estate taxes for all prior years and for Seller' s pro rata <br /> share of such taxes for the year of settle�ent. Seller shall further pay or <br /> give Buyer credit for all special assess�ents now a lien against the pre�ises, <br /> rents, if any, and all water or sewer bills or wateraain or sewer cannection <br /> charges incurred and unpaid as of settleaent. Credit to Buyer for general <br /> real estate taxes not yet payahle shall be computed on the basis of the aost <br /> current tax information available at the ti�e of settlement. <br /> 7. Huyer shall be entitled to possession of the premises at 5:00 <br /> o'clock P.M. on date of settlement. <br /> 8. No notices, suits or judg�ents relating to the premises have been <br /> received by the Seller. <br /> 9. This contract is contingent upon Buyer obtaining, at Buyer' s <br /> expense, a Phase I Environmental Audit with results satisfactory to Buyer. <br /> 10. Notice given or required in this contract or any addendum must be <br /> given in writing in one of the following forms: <br /> (i) Personally; <br /> (ii) By certified �ail, return receipt requested, properly <br /> addressed and ail charges prepaid; or, <br /> (iii? By express de2ivery with charges prepaid and addressed <br /> to the appropriate Party at the address set forth below. <br /> All natices shall be dee�ed to have been received on the date of personal <br /> service or on the 3rd day following date post�arked. Notice must be served <br /> upon or addressed to any one of the Sellers or any one of the Buyers <br /> personally unless specified otherwise.
